Central European Media Enterprises Ltd., with its registered office at O'Hara House, 3 Bermudiana Road, Hamilton, HM08, Bermuda, together with its affiliates/subsidiaries ("CME", "we" or the “Company”) as data controller provides you with this Notice to explain how we process and protect your personal data.

We provide this Notice to you at the commencement of our interaction through our website.

1. What processing is covered by this Notice?

This Notice applies to the processing of personal data of visitors to our website available at www.cetv-net.nl (“website”).

2. What information we collect about you

We collect and process your personal data when you interact with us (for example, information that you provide us by filling in forms on our website or by corresponding with us by phone, e-mail or otherwise). This includes information you provide when you subscribe to the alert service on our website and when you report a problem with our website. The information you give us may include your name and e-mail address.

We do not collect or process sensitive personal data related to you.

Each time you visit our website we automatically collect the following data:

  • technical data, for example this may include the Internet Protocol (IP) address used to connect your computer to the Internet, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform, device type and brand of mobile device; this data may be collected and processed on our behalf by third party cookies and you can find more information on this at Cookie policy.
  • data about your visit, for example this may include the full Uniform Resource Locators (URL), clickstream to, through and from our website (including date and time), page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), methods used to browse away from the page, and user behavior data

3. How we use your personal data and under what legal basis

General

We process your personal data with your consent; where we need to comply with a legal obligation (for example, laws related to auditing); and where it is necessary for our legitimate interests (or those of a third party) and your interests (for example, for the detection and prevention of fraud or ensuring network and IT security) unless your fundamental rights override those interests.

We process your personal information for various technical, administrative and operational reasons, such as to ensure that content is presented in the most effective manner for you and for your computer; to improve our website including its functionality; for administration of our website; for internal operations, including troubleshooting, data analysis, testing, research, statistical and survey purposes; and as part of our efforts to keep our website safe and secure.

In some cases, we will only process your personal data with your consent. In these cases, we will separately ask for your clear consent when you provide your personal data. You will then be able to withdraw your consent at any time via the ‘unsubscribe from email alerts’ feature on the website .  However, this will not affect the lawfulness of any processing that occurred before your withdrawal of consent.

Provision of personal data is optional and you are not obliged to provide them.

We process personal data such as your name and email address for the purpose of communication of investor information related to our Company including its related companies and subsidiaries.  We will keep these personal data until you notify us that you wish to withdraw your consent.

4. How and to whom we disclose your personal data

We do not sell your personal data to third parties.

Within the Company, only a limited number of personnel such as Investor Relations, Legal and IT Departments have access to your personal data on a need-to-know basis. Such personnel are subject to confidentiality obligations with regard to personal data. Appropriate technical and organizational measures are taken for the protection of personal data. Company personnel are only entitled to handle personal data upon the Company's instructions and if necessary in connection with their job responsibilities.

Personal data may be shared with government authorities and/or law enforcement bodies if required by applicable law or if required to enforce our rights including our terms of use or for the protection of our legitimate interests (including legitimate interests of third parties) in compliance with applicable laws.

Your personal data may also be disclosed to third parties including:

(i) service providers that provide administrative, professional and technical support to the Company for IT, security and business resources support; and

(ii) analytics and search engine providers that assist us in the improvement and optimization of our website.  

The Company will also share personal data with external advisors ( e.g., lawyers, accountants, auditors) if necessary.

We may share personal data with our Related Companies and with other third parties in the context of certain types of transactions, including any transaction involving a change of control of the Company, the sale of substantially all of its assets, or business restructurings.  

The Company seeks to perform appropriate due diligence in the selection of its third party service providers, and require that such service providers maintain adequate technical and organizational security measures to safeguard personal data, and process the personal data only as instructed by the Company. Service providers will be entitled to use subcontractors in providing the services to the Company, subject to the subcontractor complying with the same data protection obligations as the service providers.

5. Storage of your personal data and transfers abroad

Your personal data may be transferred to, and stored at, a destination outside the European Union (“EU”) and the European Economic Area (“EEA”). When your personal data is transferred from your own country to another country, the laws and rules that protect your personal data in the country to which your information is transferred to may be different (or less protective) from those in the country in which you work. We endeavor to have adequate protections in place in respect of such transfers and storage of your personal data.

6. Your rights

You may request from us confirmation as to whether or not your personal data is being processed by us, for a copy of your personal data and/or to correct it. In certain circumstances, you have the right to require us to erase your personal data or, based on your right to portability, to ask us to transfer some of your personal data to you or other entities. You also have rights to object to some processing of your personal data. Where we have asked for your consent to process your personal data, you have the right to withdraw this consent without having negative impacts on you. Where we process your personal data because we have a legitimate interest in doing so (as explained above), you also have a right to object to this. You also have the right to restrict processing of your personal data in certain circumstances.

Please note that your rights above may be limited in some situations and are subject to applicable data protection laws and regulations; for example, your right to object to the processing of your personal data may be limited where we can demonstrate that we have compelling legitimate grounds to process your personal data that may override your interests. You will need to verify your identity and provide us with other details to help us to respond to your request. We will not charge a fee in responding to your request unless permitted by law, and, where such fee is charged, it will be reasonable and proportionate to your request.

However, you also have the right to complain to the relevant data protection authorities. You can bring the complaint in the Member State where you reside, where you work or where the alleged infringement of data protection law occurred.

7. How long we keep your personal data and data security

We intend to retain your personal data only for as long as necessary in accordance with our Data Retention Policy, for no longer than is necessary to carry out the purposes listed in this Notice and/or as required by applicable law, including compliance with applicable statutory minimum retention periods, and/or as required to enforce our legitimate rights (and the legitimate rights of others). Please note we can process any of your personal data which has been anonymized without further notice to you.

Where we process your personal data based on your consent, such personal data will only be processed for the period granted by your consent unless you withdraw or limit your consent prior to expiration of such period. In such cases, we will stop processing the affected personal data for relevant purposes, subject to any legal obligation to process such personal data and/or our need to process such personal data for the purpose of enforcing our legitimate rights (including the legitimate rights of others).

8. Data Security

We s tore your data on our servers and servers hosted by third parties (including on third party cloud-based services). We use appropriate technical and organizational measures aimed to protect your personal data and to prevent unauthorized access. We have entered into contractual arrangements with such third party hosting services and such arrangements include obligations related to organizational and technical security of personal data.

The transmission of data via the internet is not completely secure. Although we will do our best to protect your data we cannot guarantee the security of your data transmitted to our website; any transmission is at your own risk. Once we have received your data, we will use strict procedures and security features to try to prevent unauthorized access.

9. Children's privacy

The Company does not knowingly collect personally identifiable data of children on this website. If a parent or guardian is aware that his/her children have provided the Company with their personal data, they should inform the Company promptly. The Company will then delete such information from its servers.
